Alleged DUI Setup in Attorney Charles Phillip Campbell Jr. Case

We have been covering the Bubba the Love Sponge Clem defamation trial from the beginning, including the unfortunate timing of his opposing counsels’ very public driving under the influence arrest in Tampa that served to delay the trial a bit. For a quick recap: attorney Charles Phillip Campbell Jr. was arrested for his second DUI (the first one occurring in 2008) after leaving a local Tampa bar. He refused to take a blood alcohol test and his ordeal delayed the trial another week.

Now it seems that there is a little more to the night at the bar than may initially meet the eye. Reports this week have been swirling around a possible set-up by the law firm that was representing Bubba the Love Sponge Clem in the case with Campbell. My Fox Tampa Bay reports that the police officer that made the arrest was tipped off by a phone call as to the whereabouts and activities of Mr. Campbell, and that was not the first time that he received a call about Mr. Campbell drinking and driving. The Times quotes Sgt. Ray Fernandez on the questionable situation, “What he told me is that this guy goes to Malio’s and that he drinks and that he drives home. I also received this phone call prior, a month prior, also where we also tried to locate that defendant and we didn’t.”

There’s nothing wrong with getting tips but two calls did make Campbell’s defense team begin to question the situation. Here are the details the Times reports that turn this tip into a potential setup: the phone calls were made from the office building of opposing law firm and the woman he was drinking with the night he was arrested was a paralegal that worked for the very firm he was in the middle of a public trial with. Campbell was also arrested for his DUI in the paralegal’s car. At this point, Campbell’s attorneys not only seek to have the Bubba the Love Sponge Clem trial declared a mistrial but the team is also looking into the details of the DUI.

Sure the police can pull over an individual based on a tip. In fact, it is not necessarily uncommon for a bartender or restaurant owner to alert authorities if they fear a patron may be attempting to drive or engage in another activity in an impaired capacity. The reality is the tip is nothing more than a heads up—the driver in question still has to actually be driving under the influence and the police have to trust the information enough to go looking for the individual.

Were You Arrested for Driving Under the Influence in Glendale on Super Bowl Sunday? (You’re Not Alone!)

Everyone can admit that the Har-bowl was pretty epic, and kudos to Joe Flacco and the Ravens for pulling off a crazy playoff streak. But Super Bowl Sunday is traditionally one of the most dangerous days of the year for DUI. Why is this so? Why do so many people get arrested during the holiday?

Perhaps it has to something to do with all the Bud Light commercials. Statistically, when more people drink and party, more people drive DUI and get arrested for the crime – it’s just a number’s game.

Of course, you’re not just “a number” – you’re a human being whose California driver’s license now may be on the line. You may also be at risk for serious fines, probation, jail time, spikes in your insurance rate, and a variety of other unpleasantries. So what can you do?

First of all, recognize that you may have a lot of legal resources available. For instance, let’s say that you failed a Glendale breathalyzer test — you blew a 0.12%, which is 1.5 times the legal limit for Glendale DUI, as codified by California Vehicle Code Section 23152 (a) and 23152 (b). You might be under the (false) impression that the breathalyzer results are set in stone. That is, they cannot be challenged because breathalyzers are technical instruments and thus never fail.

That’s not true. Surprisingly compelling research suggests that breath tests fail way more often than most people believe. This is often why police officers ask you to take a deep breath before you blow into a breath test – they know the game.

Tampa Bay DUI Officers Watch Bar Parking Lots. We recently got some interesting video of testimony from a top DUI Sargeant in Tampa Bay DUI law enforcement. He candidly admits the obvious – cops sit on bar parking lots. 
We have suspected this for years but, to his credit, the officer in the video tells us they watch parking lots, act on tips received by phone and other types of electronics messages. We have protected the identity of the officer and give him credit for testifying so candidly. Tips to watch locations come from Phone Calls from Bar Managers, letters, pictures he says, “I get all kinds of stuff.”

Assume this is the practice everywhere – Pinellas, Pasco, and Hillsborough counties in Florida. One DUI attorney has said “as there was a basis for the traffic stop and probable cause for the arrest, how or why an officer got involved in a DUI stop is irrelevant.”
